Motorcycle Accident Lawyers – New York
For over six decades, the Long Island motorcycle accident lawyers at Edelman, Krasin & Jaye have been protecting the rights of crash victims and their loved ones. If a motorcycle accident in NY results in injury or death, we stand ready to investigate the circumstances of the crash, and determine who or what was at fault, how much damage to property was caused, and what your legal options may be.
Finding the cause or causes of a motorcycle crash can be very complicated. Because motorcycle accidents so often result in serious injury or death, the motorcyclist may not be able to supply an eyewitness account of the crash. The Long Island car accident lawyers at Edelman, Krasin & Jaye work hand in hand with expert crash investigators who can help establish precisely what caused the accident. We also work with medical experts who can assess the extent of a victim’s injuries and impairments, and estimate the cost of future treatment and therapies.

Motorcycle accident injuries
When a motorcycle is involved in an accident, the driver is almost always injured – usually severely, sometimes fatally. In New York State, 98% of all motorcycle crashes in 2012 resulted in injury or death to the driver, even though 80% of the drivers were wearing helmets at the time. Over 5,900 motorcycles in New York were involved in accidents in 2012, injuring 5,820 and killing 173. More than half of the crashes involved one or more additional vehicles.
When accidents on Nassau County roadways in 2007 resulted in $80 million in hospital and emergency room charges for injury treatments, the highest average charges were for motorcyclists. Average hospitalization charges exceeded $30,000; at least 130 motorcycle riders were hospitalized after crashes in Nassau in 2007.
Meanwhile, from 2007 to 2009, nearly 10% of all the motorcycle accidents in New York State occurred in Suffolk County. Of the 1420 motorcycle accidents reported in Suffolk in this time period, 57 were fatal. According to statistics reported by the Institute for Traffic Safety Management and Research, the majority of these accidents occurred on the weekends during the afternoon hours, and an overwhelming 95% involved male drivers, approximately 60% of whom were under the age of 40.
Accidents of this type are all too common, both in New York and across the country. Nationwide, 4,612 motorcyclists were killed in accidents in 2011, while 81,000 were injured. Sadly, these numbers showed an increase over the prior year.
New York law requires motorcycle drivers and passengers to wear helmets at all times; drivers are also required to wear protective goggles.
Injuries from motorcycle accidents may include:
- Injuries to the head, brain, neck and spinal cord
- Broken bones throughout the body
Motorcyclists involved in accidents can incur steep medical bills; lose wages for months or years of recovery; suffer acute physical and emotional pain; and experience other serious, permanent losses.
Consulting an attorney with experience in motorcycle accidents, like the lawyers at Edelman, Krasin & Jaye, can make all the difference in recovering compensation for these losses.
Causes of motorcycle accidents
Over half of New York motorcycle accidents involve one or more additional motor vehicles. In many instances the motorcyclist is not responsible for the accident. All motorists, including those who drive cars, trucks, buses, and other motor vehicles, are required to treat motorcycles and their drivers in the same way as all other vehicles.
Unfortunately, when motorists fail to exercise proper care, typically it is the motorcyclist who bears the brunt of the harm.
Examples of negligent driving that lead to motorcycle accidents include:
- Failure to yield right of way
- Driver inattention or distraction
- Following too closely
- Improper passing or lane usage
The driver of a car or truck that causes a motorcycle accident may be held responsible for all damages resulting from the crash.
With over 60 years of experience representing Long Islanders in personal injury lawsuits involving motorcycle and motor vehicle accidents, Edelman, Krasin & Jaye will bring your case to resolution as swiftly and effectively as possible.
Motorcycle accident liability
Our NY accident attorneys have the expertise and resources to determine if something other than another driver’s negligence caused a motorcycle crash. For example, defective parts or maintenance on a car or truck may have played a part in the accident. In these cases, the motor vehicle manufacturer, dealer, or mechanic may bear some responsibility.
In other instances, New York State, Nassau or Suffolk County, or the City of New York may have failed to maintain a highway, road, intersection, shoulder, or traffic light. If a particular stretch of roadway has been the site of accidents in the past, and the state or city has failed to upgrade its condition to make it safe to travel, motorcycle crash victims may recover damages from the entity responsible for road maintenance.
Similarly, when substandard road or traffic work causes a motorcycle accident, the responsible government entity may be liable for compensating the injured party.
