$7.25 Million Mesothelioma Lawsuit Verdict for Asbestos ExposureNew York mesothelioma lawyers are encouraged by the latest jury award of $7.25 million to the family of a man who died from asbestos exposure. Edward Merwitz died in July 2010. Allegedly, he was exposed to asbestos fibers during the 1960s while working in the bilge section of warships at a naval shipyard. The nine asbestos product manufacturers named in the lawsuit offered the family a $2,500 settlement before the trial began, but the family rejected the agreement. The offer was approximately .035 percent of what the jury awarded the family of the deceased man.

The allegations raised during the trial included testimony and/or evidence that the defendants allowed employees to work around asbestos containing materials such as gaskets, motors, and other components without advising employees of the potential health risks and/or providing them with proper personal safety equipment.

Plaintiffs may have been encouraged not to settle because approximately one year prior a historic verdict was handed down in an NYC mesothelioma lawsuit for the astounding amount of $190 million. The defendants in the case were two boiler companies: Cleaver-brooks Inc. and Burnham LLC. Both companies refused to settle with construction workers who were exposed while working in their particular trade.

The huge verdict went to the five workers named as plaintiffs or their surviving family members. Three of the plaintiffs had already passed away from mesothelioma or related complications at the time of the verdict.

What is mesothelioma?

Malignant mesothelioma is a relatively rare form of cancer with one known cause – exposure to asbestos fibers. The cancer starts in the cells of the lining of various parts of the body, especially the chest and abdominal cavities. The cells cover the outer surface of most of the body’s organs including the heart, stomach, and lungs. The cells of the lining are called mesothelial and the lining made up of the cells is called mesothelium. Most of the malignant cases begin in the pleural or chest lining. The bulk of the remaining cases starts in the abdomen lining. A very small percentage of cases affect the heart or testicular lining.

Malignant mesothelioma can develop as late as 10 to 40 years after exposure to asbestos fibers.

Typical state statute of limitations for people diagnosed with this dangerous form of cancer is five years after diagnosis. However, some states only allow one year to file a lawsuit following a confirmation of the cancer. In cases where a person has already died, the victim’s spouse or heirs usually have one to three years to file a wrongful death suit.
