Massapequa Motorcycle Crash Causes Serious Injury

Motorcycle Accident

A 69-year-old motorcyclist had to be airlifted to a nearby hospital after sustaining a serious injury in a crash in Massapequa. The motorcycle crash occurred on October 30, 2015 in the afternoon. Detectives who responded to the scene stated that the unidentified motorcyclist was traveling northbound on Hicksville Road through the intersection at Sunrise Highway. An unidentified 23-year-old driver of a Toyota Corolla was apparently driving southbound and attempting to make a left-hand turn onto Sunrise Highway when the two vehicles collided.

No injuries were reported for the driver of the Corolla, but the motorcyclist was said to have a serious, but non-life-threatening leg injury. The crash shut down the westbound highway between Rt. 107 and Broadway. Photos of the crash site depict the Corolla as having damage to the left side. The cause of the crash is still under investigation, but police investigators have said that no criminal charges are pending. Police impounded both vehicles for brake and safety checks.

Establishing liability in motorcycle accident cases

Motorcycle accident cases present unique challenges, due in no small part to the public perception of motorcyclists as being reckless. Yet, a significant portion of motorcycle accidents are actually caused by careless or reckless drivers. When establishing liability, an attorney may demonstrate that the motorcyclist exercised reasonable caution for the safety of other motorists and pedestrians by riding within the speed limit, using turn signals and otherwise obeying traffic rules.

The lawyer representing the motorcyclist may then use physical evidence and witness statements to prove negligence on the part of the driver. The specific evidence used depends on the circumstances of the crash. For example, cellphone records may prove that a driver was distracted behind the wheel. Additionally, many motorcycle accidents occur at intersections. As with the case of the 69-year-old Massapequa motorcyclist, a rider may be traveling straight through an intersection while a driver heading in the opposite direction is attempting to make a left-hand turn. Since drivers often misjudge the distance and speed of a motorcycle due to its smaller size, they may turn left in front of the bike and cause a collision.

A personal injury attorney can help victims of motorcycle accidents explore their legal options. This may include negotiating a fair settlement from the insurance carrier. However, it’s not in the insurance carrier’s best interests to fully cover the medical expenses and property damage, which is why some motorcyclists may choose to file a personal injury lawsuit.

When preparing a personal injury complaint, an attorney will assess damages. The motorcyclist may have incurred ambulance-related costs, diagnostic fees, hospitalization expenses, and treatment costs. Property damage is also likely. In cases in which the motorcyclist was killed, the surviving family members may sue for wrongful death and loss of support.
