NY Amusement Park Accidents Pose Summer Risk

roller coasterSummer is the time for New Yorkers to enjoy the many amusement and water parks available in the Tri-State area, such as Adventureland and Splish Splash on Long Island and Six Flags Great Adventureland.

However, in the midst of the thrilling attractions lurks a very real danger of injury. If you or someone you love is hurt at a water or amusement park ride in the state, you may be eligible to file a personal injury lawsuit in New York to pursue compensation for your medical bills and economic losses.

Prevalence of amusement park accidents

There were more than 1,100 reportable injuries and another 84 serious injuries at amusement parks in 2013, according to the National Safety Council (NSC). Serious injuries were classified as those that required immediate hospitalization for more than 24 hours. More than half of the injuries recorded by the NSC occurred on family and adult rides, while just over 40 percent involved roller coaster accidents.

Some 27.6 percent of all deaths caused by amusement park rides involve roller coasters. As roller coasters become faster and taller, as well as increasing their g-force, the incidence of injuries and deaths is not likely to go down. Ferris wheels, gondolas and cable rides followed roller coasters, causing just over 20 percent of amusement park deaths.

Types of park injuries

There are many types of injures that can occur at water and amusement parks, including:

  • Lacerations, fractures and torn ligaments
  • Head, neck and spinal cord injuries
  • Traumatic brain injuries
  • Brain aneurysms
  • Drowning
  • Slip and fall injuries

Causes of amusement and water park injuries

Injuries at amusement and water parks can occur for many different reasons. Some of the most common include mechanical failure of the ride, which could be due to a manufacturing defect or the park’s failure to maintain the ride properly.  The ride may also be subject to improper operation, such as a seatbelt that is not latched properly, leaving the rider vulnerable to injury during the ride. In some cases, injuries may occur when a rider does not follow safety instructions. Overcrowding can also be a problem, particularly at water parks where crowded waters could prevent a lifeguard from seeing someone in trouble.

Injuries may also occur due to the nature of the ride itself. For example g-force and rapid spinning can lead to traumatic brain injury, cerebral hemorrhage and loss of consciousness. Other rides can cause bruising or lacerations due to bumping around during the ride.

Filing an amusement park accident lawsuit in NY

If an injury occurs at an amusement or water park it can be difficult to know who might be liable for the injuries. Park owners may be held responsible if the injury was due to failure of the park to maintain or operate the ride properly. Owners may also be liable if the injury was the result of an unsafe environment, such as a slip and fall accident caused by slippery wet surfaces.

Park employees may also be held responsible for an amusement park accident, if it can be proven that the employee was willfully reckless or negligent in their performance of their job. In some cases, both the park owner and the employee may share liability for an accident. The park visitor that was injured may also be held responsible if the injury was caused by failure to obey the safety rules on the ride.
