Mass Tort Law Suits

What is Mass Tort?

A mass tort lawsuit is a wrongdoing a person or company commits which results in harm to others at a mass level, combining the claims of numerous plaintiffs into a single case. Combining the claims makes the process much faster, economical, and efficient. This type of case could result in compensation for all plaintiffs involved in the action.

Why Join the Lawsuit?

If you are the victim of a harmful drug, defective product, environmental hazard, you may qualify to join a mass tort lawsuit against the defendant. For example, if you were diagnosed with cancer after utilizing a product and others have faced the same results, joining would make sense. In this example, instead of thousands of plaintiffs bringing claims against the same defendant for the same or similar issues, they can join a mass tort. The process of combining claims centralizes the cases in multi-district litigation (MDL) that will occur in one courtroom, under a single judge. The streamlined legal process allows for a more rewarding experience for all involved.  Unlike class actions, in which the courts give only one trial and do not individualize plaintiffs, mass torts have separate trials and individual results. As a result, statistics have shown that recovery in mass tort lawsuits is often much higher than in class actions suits.

It may be worth your while to join the lawsuit if you are one of many victims, are located near other victims, if your injuries are like the injuries of other plaintiffs, and/or if all claims center on a common cause, such as a single product or environmental disaster. These are a few of the courts’ elements when permitting a mass tort action. Our attorneys can help you understand whether you’re eligible to join or file a mass tort. If the tort is successful, you could receive compensation for your medical bills, pain and suffering, and other related damages.
