Legal Rights and Options for Car Accident Victims

Even if you carefully follow traffic rules, your safety on the road is partly dependent upon the behavior of other drivers. A negligent or intoxicated driver can seriously injure others and claim lives in a matter of seconds – something that several local families were recently reminded of.

If you or a loved one has sustained injuries in a collision, Long Island car accident attorneys can advise you of your legal right to demand compensation.

Serious injuries result from recent car crashes

One of the recent car accidents on Long Island occurred on April 22nd. Sean McKenna, 51, of Seaford was traveling eastbound on Jerusalem Ave. According to investigators, the suspect struck five different vehicles and continued to drive. Subsequently, he reportedly drove off the road, struck a Post Office mailbox, and plowed through about 100 feet of fencing before striking a utility pole.

Responding officers determined that McKenna was allegedly intoxicated and promptly arrested him. The officers also reported finding two bags of heroin in his vehicle. The multiple auto accidents allegedly caused by the drunk driver resulted in at least two injuries. A 28-year-old man was diagnosed with a fractured pelvis, collapsed lung, and lacerated spleen. His female passenger was fortunate to escape the crash with only a contusion on her forehead. It is unknown if the victims plan to consult an attorney regarding their car accident.

Another serious crash that also occurred on April 22nd is currently under investigation by Suffolk County Police. Sixth Squad detectives are investigating the death of a motorcyclist in Holtsville. According to investigators, a tractor trailer attempted to make a right-hand turn into Bissett Nursery. A motorcycle traveling in the same direction struck the back of the tractor trailer. The motorcyclist was thrown from the bike. The bike was then dragged under the truck, at which point it caught fire. The victim, Leonard Mastro, was transported to a local hospital, but did not survive. It is unknown if the truck driver will face criminal charges or a civil lawsuit.

Understanding your legal rights

A car accident attorney can analyze Long Island crashes to assess whether negligence, intoxication, or other factors may have contributed to the accident. The other driver may be considered negligent if he failed to exercise the ordinary degree of care that any other safe driver would under similar circumstances. A personal injury attorney may find evidence demonstrating that this breach of duty to exercise caution on the road led to the victim’s injuries or to the loss of life.

Victims of car crashes have many legal rights when negligence is involved, including the following:

  • The right to consult a lawyer before giving a statement to the other driver’s insurance company.
  • The right to demand damages for physical injuries, emotional suffering, property damage, and lost wages.
  • The right to file a car accident lawsuit if an insurance company’s settlement offer is not just.
